Delhi Ordinance case: Supreme Court may refer case to Constitution Bench

On July 17, the Supreme Court expressed its intention to potentially refer the Delhi government\’s petition against a Central Ordinance to a Constitution Bench for a definitive ruling. The said Ordinance grants authority over civil services in the national capital to the Lieutenant Governor. Chief Justice of India D.Y. Chandrachud, leading a three-judge Bench, made this observation.

Despite the submission made by Solicitor General Tushar Mehta, representing the Centre, that the Ordinance would be presented in Parliament during the upcoming Monsoon Session starting on July 20, the court signaled its inclination to refer the case to a Constitution Bench. Mr. Mehta requested the court to wait and observe the actions taken by the Parliament regarding the Ordinance. He emphasized that certain sections might be amended, and since no prejudicial action is being taken based on the Ordinance presently, the court should consider waiting for the legislative decision.
