In light of the petition filed by the Punjab government challenging Governor Banwarilal Purohit\’s withholding of vital Bills, the Supreme Court has declared that a Governor, deciding to withhold a Bill without subsequent action, would be acting contrary to the Constitution. The court has set a precedent, affirming that if a Governor decides to withhold assent, they must expeditiously return the Bill to the State Legislature, accompanied by a message urging a reconsideration of the proposed law.
Should the State Assembly reaffirm the Bill, with or without amendments, the Governor is mandated to grant assent without any discretion or alternative options.
